Policies & Terms

These terms protect both the artist and the collector. Please read them carefully before purchasing artwork, commissioning a piece, or booking an appearance.

Website Image Protection

This website employs technical measures to protect the Artist's work, including disabled right-click context menus, drag protection, on-screen watermarks, and print-screen deterrents. These measures exist to prevent unauthorized reproduction.

No Circumvention

Attempting to bypass, disable, or circumvent any image protection measure on this site — including but not limited to inspecting page source, using screenshot tools, browser extensions, or developer tools to extract images — is prohibited and may constitute a violation of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 1201, which prohibits the circumvention of technological protection measures.

Watermarked Images

All images displayed online are watermarked or low-resolution. The full-quality, un-watermarked artwork is available only through authorized purchase or with written permission from the Artist.

Commissioned Works

The following terms govern all commissioned artwork. By requesting a commission, the client agrees to these terms. A separate written agreement may supersede specific terms for individual commissions.

Deposit & Payment

A non-refundable deposit of 50% of the agreed total is required before work begins. This deposit secures the Artist's time and materials. The remaining balance is due upon completion and prior to delivery. Failure to pay the final balance within 30 days of notification may result in forfeiture of the deposit and the Artist retaining the completed work.

Copyright on Commissions

Unless a separate written "Work for Hire" or copyright transfer agreement is signed and additional fees are paid, the Artist retains copyright and all reproduction rights for commissioned works. The client receives the physical artwork for personal enjoyment only. Commercial use, reproduction, or licensing of a commissioned work requires a separate commercial license agreement.

Reference Materials

The client is solely responsible for ensuring that any photographs, references, or materials provided for a commission are either owned by the client, properly licensed, or in the public domain. The Artist is not liable for copyright infringement arising from client-supplied reference materials. The client indemnifies and holds the Artist harmless from any claims related to such materials.

Revision & Approval

Commissions include up to two rounds of revisions during the creation process. Additional revisions may incur additional fees. Once a final piece is approved in writing by the client, no further changes will be made. Approval of a preview image constitutes approval of the final composition.

Refunds

Because commissioned work is created specifically for the requesting client, no refunds are available once work has begun. The non-refundable deposit covers the Artist's committed time and materials regardless of project cancellation.

Cancellation by Artist

The Artist reserves the right to decline or cancel any commission at any stage, in which case any deposit paid will be refunded in full minus a fair deduction for work already completed. The Artist is not obligated to provide a reason for declining a commission.

Timeline

Estimated completion times are estimates, not guarantees. The Artist is not liable for delays caused by client feedback delays, unforeseen circumstances, or force majeure events.

Original Artwork Sales

The following terms apply to the sale of original artworks (paintings, sculptures, mixed media, etc.).

What You Receive

The buyer of an original artwork receives the physical artwork and the right to display it. Unless accompanied by a separate written agreement, the Artist retains copyright and all reproduction rights, including the right to produce and sell prints, reproductions, or derivative works based on the original.

No Reproduction

The buyer may not reproduce, photograph for reproduction, or create derivative works from the original without written permission. Displaying the work in a private collection, home, or office is permitted. Public display, gallery exhibition, or commercial use of the image requires a license.

Resale

The buyer may resell the physical artwork. The Artist retains copyright regardless of resale. The buyer is requested (though not obligated under California Resale Royalty Act where applicable) to notify the Artist of any resale. Under no circumstances does resale transfer copyright.

Condition

Original artworks are sold "as is" in the condition at the time of sale. The Artist is not liable for deterioration, fading, or damage occurring after purchase due to improper handling, display, or environmental conditions. Care instructions are provided and should be followed.

Appearances, Events & Workshops

These terms govern live appearances, exhibitions, workshops, demonstrations, talks, and any in-person or virtual events featuring the Artist.

Booking & Scheduling

All appearances are subject to availability and the Artist's sole discretion. A booking is confirmed only upon receipt of a signed agreement and any required deposit. Verbal or informal discussions do not constitute a confirmed booking.

Deposit & Cancellation

A deposit may be required to secure an appearance date. Deposits are non-refundable if the event organizer cancels within 30 days of the scheduled date. If the Artist must cancel, all fees paid will be refunded in full. The Artist is not liable for expenses incurred by the organizer in the event of cancellation due to force majeure.

Recording & Broadcasting

No appearance, workshop, or event may be recorded, photographed for commercial use, live-streamed, broadcast, or reproduced in any medium without the Artist's prior written consent. The Artist retains all rights to their likeness, voice, and performance, including the right to approve any resulting recordings or images. Unauthorized recording is prohibited.

Liability at Events

The event organizer is responsible for providing a safe venue, adequate insurance, and any required permits. The Artist is not liable for injury, loss, or damage occurring at events. Organizers agree to indemnify and hold the Artist harmless from any claims arising during the event.

Travel & Expenses

For appearances requiring travel, all transportation, lodging, and meal expenses are the responsibility of the organizing party unless otherwise agreed in writing. A travel surcharge may apply.

Right to Decline

The Artist reserves the right to decline any appearance, workshop, or event for any reason, including but not limited to scheduling conflicts, safety concerns, or misalignment with the Artist's values or brand.

Licensing & Commercial Use

Commercial use of any artwork — including use on products, merchandise, packaging, advertising, publications, websites, film, or any revenue-generating context — requires a separate written licensing agreement with the Artist.

No Implied License

No license is granted by the sale of an artwork or print. Any commercial use without a written license is an infringement of copyright and may subject the user to statutory damages, attorney's fees, and injunction under 17 U.S.C. § 504–505.

License Terms

Licenses are non-exclusive, non-transferable, and limited to the specific use, duration, and territory described in the agreement. The Artist retains all rights not explicitly granted. Licenses must be obtained before any commercial use begins.

Limitation of Liability

YOU ACKNOWLEDGE THAT ALL ARTWORK, PRODUCTS, SERVICES, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

No Warranties

The Artist disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Artistic materials, colors, and dimensions are approximate and may vary.

Liability Cap

To the maximum extent permitted by law, the Artist's total liability for any claim arising from the use of this website, the purchase of artwork, commissions, appearances, or any related service shall not exceed the amount actually paid by the user to the Artist for the specific product or service giving rise to the claim.

Exclusion of Damages

In no event shall the Artist be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, or emotional distress, arising from the use of or inability to use this website or any product or service, even if advised of the possibility of such damages.

Assumption of Risk

By using this website and purchasing artwork or services, the user assumes all risk associated with such use. The Artist does not guarantee that the website will be uninterrupted, error-free, or free of harmful components.

Indemnification

The user agrees to indemnify, defend, and hold harmless Willis Wright, Afrocentric Art Space, and their affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses — including reasonable attorney's fees — arising from:

User Misconduct

The user's violation of these terms, including unauthorized reproduction, circumvention of image protection, or misuse of artwork or content.

Infringement by User

The user's use of artwork or content in a manner that infringes the intellectual property rights, privacy rights, or any other rights of the Artist or any third party.

Client Materials

Any claim arising from reference materials, photographs, or other content provided by a client for commissions or other services, including claims that such materials infringe a third party's rights.

DMCA / Copyright Takedown Notice

If you believe that your copyrighted work has been copied in a way that constitutes infringement on this website, please submit a notification under the Digital Millennium Copyright Act (DMCA) with the following information:

Required Information

(1) A physical or electronic signature of the copyright owner or authorized agent; (2) Identification of the copyrighted work claimed to have been infringed; (3) Identification of the material that is claimed to be infringing, including its location on this site; (4) Your contact information; (5) A statement that you have a good faith belief that the use is not authorized by the copyright owner; (6) A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.

Counter-Notice

If you believe material was removed in error, you may submit a counter-notice with the information required by 17 U.S.C. § 512(g)(3).

Privacy & Newsletter

Your privacy is respected. This policy explains how your information is handled.

Information Collected

When you subscribe to the newsletter, place an order, or submit an inquiry, the Artist collects your name and email address. Payment processing is handled by secure third-party processors; the Artist does not store credit card information.

Use of Information

Your information is used solely to fulfill orders, respond to inquiries, and send exhibition and studio updates. Your information is never sold, rented, or shared with third parties for marketing purposes.

Unsubscribe

You may unsubscribe from the newsletter at any time by clicking the unsubscribe link in any email or contacting the Artist directly.

Dispute Resolution & Governing Law

These terms and any dispute arising from them shall be governed by the laws of the State in which the Artist resides, without regard to conflict of law principles.

Good Faith Resolution

The parties agree to first attempt to resolve any dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, the parties agree to submit to binding arbitration.

Arbitration

Any unresolved dispute shall be resolved by binding arbitration conducted in the Artist's home jurisdiction, under the rules of the American Arbitration Association. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class Action Waiver

The parties agree that any arbitration shall be conducted on an individual basis only, and not as a class action or representative proceeding. The parties waive any right to participate in a class action.

Venue

Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in the Artist's home jurisdiction.

Severability & Waiver

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

Changes to This Policy

The Artist reserves the right to update or modify this policy at any time. Changes will be posted on this page with an updated effective date. Continued use of this website or continued purchase of artwork or services after changes are posted constitutes acceptance of the revised terms. It is the user's responsibility to review this policy periodically.
